Previous: Affiliates and Tax Liability Here's a heads up about misleading mail being sent to employers about labor law posters. There's a company sending email (and possibly mail through conventional mail) alerting employers ... to the fact that coverage under the FMLA has been extended. That statement, by itself, is true. But the email is misleading. Here's why: Below that factual statement is another true statement that employers are required to post a number of other federal labor law posters. The email goes on to say that the company's posters "now" include all 6 required posters. What's misleading is that the way the email is worded, it implies (because it states coverage under the FMLA has been extended) that there is a new required FMLA poster and that the company has incorporated the new required FMLA posting into their posters. While I haven't seen exactly what's on that company's posters, the truth is that the official FMLA poster has not been changed as of the date of this post. The US Department of Labor (DOL) has issued an informational notice that can be hung in the workplace along with the current poster, but from our understanding even this notice is not required to be posted at this time. (And it can be downloaded for free from the DOL website.) Furthermore, it's quite likely the Department of Labor will make changes to the required posting later this year. Thus any poster purchased now with the FMLA on it will become outdated when the DOL does actually issue the final version of the poster.
